El sábado 17 de octubre de 2009, se realizaron manifestaciones y otras acciones en 38 ciudades de Europa, Latinoamérica, Norteamérica y Asia en apoyo a la Campaña Alto a la Patologización Trans STP 2012, convocadas por la Red Internacional de Despatologización Trans. A fecha de hoy, 181 grupos provenientes de 40 países de diferentes regiones del mundo y 7 redes internacionales han declarado su adhesión a la convocatoria.

La demanda principal de la campaña es la retirada del Trastorno de Identidad de Género de los catálogos diagnósticos internacionales (DSM-IV y CIE-10). Consideramos que la clasificación de la transexualidad como enfermedad mental fomenta el riesgo de transfobia y exclusión social de personas trans en todo el mundo. La obligatoriedad del diagnóstico psiquiátrico y de la modificación corporal hormonal y quirúrgica presente en muchas de las leyes existentes, atenta contra los derechos humanos de integridad corporal y libre expresión de las identidades de género, derechos recogidos en declaraciones internacionales recientes como los Principios de Yogyakarta (2007) o las recomendaciones del Comisario de Derechos Humanos del Consejo de Europa Thomas Hammarberg (2009). En este sentido, consideramos la despatologización de la transexualidad como un primer paso imprescindible para el pleno reconocimiento de los derechos humanos de las personas trans.

A la vez, la Red Internacional de Despatologización es consciente de la importancia de garantizar los derechos sanitarios de las personas trans. Por eso, incluye entre sus objetivos la demanda de libre acceso a la hormonación e intervención quirúrgica, sin necesidad de autorización psiquiátrica para aquellas personas que lo requieran, y su cobertura por los Sistemas de Salud Públicas. Para garantizar estos derechos sanitarios, la Red Internacional de Despatologización apoya una mención no patologizante en el CIE, siempre que esta mención no signifique una reclasificación de la transexualidad como enfermedad mental, orgánica o neurológica. La justificación de los derechos sanitarios de las personas trans no debería basarse en una definición patologizante de las identidades trans, sino partir de las características de una sociedad profundamente binaria en la que la transfobia y presión social vivida pueden llevar a la necesidad de modificación corporal. Cuestionamos el orden binario de género vigente en la sociedad actual en la que se sigue aceptando mejor a un hombre con cicatrices que a un hombre con pechos.

En este sentido, demandamos que el tratamiento médico sea una opción de libre elección para las personas trans, sin que haya una obligatoriedad de diagnóstico psiquiátrico, hormonación o intervención quirúrgica para la modificación del registro de nombre y/o sexo.

Un año más, el 17 de octubre de 2009 nos manifestamos a favor de la despatologización de la transexualidad, haciendo una llamada a todos los gobiernos, organismos internacionales y a la sociedad en general para demandar y apoyar la retirada del Trastorno de Identidad de Género del DSM-IV y CIE-10. Nos gustaría dar las gracias a todos los grupos, redes y personas individuales que están apoyando la campaña STP 2012.

Action Day October 17^th 2009 – STP 2012 Campaign

On Saturday, October 17^th 2009, demonstrations and other actions was taken place in 38 cities in Europe, Latin America, North America and Asia, to support the campaign Stop Trans Pathologization STP 2012, which was initiated by the International Trans Depathologization Network. To date, 181 groups from 40 countries in different world regions and 7 international networks declared their support of the campaign.

The principal demand of the campaign is the removal of Gender Identity Disorders from the international diagnostic catalogues (DSM-IV y ICD-10). We consider that the classification of transsexuality as mental disorder fosters the risk of transphobia and social exclusion of trans persons all over the world. The necessity of compulsory diagnosis, hormonal and surgical modifications which is present in many of the existent laws, attacks the human rights regarding body integrity and free expression of gender identities, rights which are named in recent international declarations like the Yogyakarta Principles (2007) or the recommendations of the Commissioner of Human Rights of the Council of Europe Thomas Hammarberg (2009). In this sense, we consider the depathologization of transsexuality as a first indispensable step for a full recognition of trans persons’ human rights.

At the same time, the International Trans Depathologization Network is aware of the importance of guaranteeing trans persons health rights. Therefore, within its objectives the demand of free access to hormonal and surgical interventions without the necessity of psychiatric authorization for those persons, who wish to use them as well as its coverage by Public Health Systems is included. To guarantee these health rights, the International Trans Depathologization Network supports a non-pathologizing mention in the ICD as long as this mention does not signify a reclassification of transsexuality as a mental, organic or neurological disease. The justification of trans persons’ health rights should not be based on a pathologizing definition of trans identities, but take into account the characteristics of a highly binary society in which the experience of transphobia and social pressure can lead to the need of corporal modification. We question the current binary gender order in the actual society, in which a man with scars continues to be more accepted than a man with breasts.

In this sense, we demand medical treatment as a free option for trans people, without the need of compulsory psychiatric diagnosis, hormonal or surgical interventions in order to realize a change in the name or sex register.

Like the years before, this year on Octubre 17^th 2009 we demonstrated for the depathologization of transsexuality, making a call to all governments, international bodies and the general society to support the demand of the removal of the Gender Identity Disorders of the DSM-IV or ICD-10.

La ministra austriaca de justicia, Claudia Bandion-Ortner, del Partido Conservador presentó ayer un borrador con respecto al registro de parejas del mismo sexo. De adoptarse, sería la peor ley del mundo para parejas.

El proyecto de ley será adoptado por el gobierno federal austriaco el 17 de noviembre y pasará al Comité de Justicia del Parlamento Federal el 3 de diciembre. Se espera que el pleno lo vote entonces tan rápidamente que la ley puede entrar en vigor el 1 de enero del 2010.

Austria es uno de los pocos países en Europa Occidental que sigue sin tener reconocimiento institucional legal para parejas del mismo sexo. El borrador de ley constituye una provocación masiva para los gays, lesbianas y bisexuales de Austria, quienes, durante mucho tiempo, han estado esperando la igualdad ante la ley.

El proyecto de ley crearía la peor ley para parejas en el mundo

Regula sólo asuntos civiles y criminales; es decir, derechos civiles mutuos y obligaciones de los miembros de la pareja (mantenimiento, apoyo, residencia conjunta, fidelidad, división de la propiedad, etc.). Incluso en el ámbito de asuntos civiles y criminales, el borrador no promueve ni crea igualdad. Más bien establece 22 desviaciones con respecto a la ley para el matrimonio.

Obligaciones sin derechos

Tampoco contiene los derechos sociales que se conceden al matrimonio exactamente porque los contrayentes asumen obligaciones mutuas (nada en relación al pago de impuestos, pensión, seguridad social, empleo, inmigración, ciudadanía, etc., etc.; y nada a nivel de la ley de los nueve estados). El Ministerio de Justicia no incluyó una cláusula tipo “cajón de sastre” que concedería a las parejas registradas las mismas referencias hechas al matrimonio en la ley (federal). Debido a este rechazo, para esos derechos sociales, todos los otros ministros ahora tienen que presentar sus propios proyectos de ley. Es muy improbable que puedan y quieran presentarlos en las próximas dos semanas, si acaso…

El Ministro de Justicia ni siquiera desea ver a las personas homosexuales en la oficina del registro civil y prohíbe que las parejas del mismo sexo se presenten ahí, adonde acuden las que se quieren casar. Su borrador pide que el registro de las parejas del mismo sexo se realice en aquellas oficinas donde habitualmente se efectúen los registros para animales o vehículos…

Si este borrador se convierte en ley, el estado desde el inicio del acto de registro demostraría de forma contundente a las parejas del mismo sexo que su estatus es como ciudadanos de segunda clase. Ningún gobierno en el mundo se ha atrevido a presentar una ley para parejas que demuestre tanta discriminación.

El año pasado las organizaciones LGTB se dirigieron al público en una rueda de prensa conjunta para mandar un inequívoco mensaje colectivo: si no hay igualdad en todas las áreas de la ley, el status quo sería incluso mejor. Hoy día, las parejas del mismo sexo no tienen los derechos correspondientes al matrimonio. Pero tampoco tienen las obligaciones. Si esta propuesta se convierte en ley, las parejas del mismo sexo registradas tendrían todas las obligaciones del matrimonio sin los derechos correspondientes al matrimonio. Se trata de una provocación inaceptable.

“Ya hemos aceptado componendas incluso en áreas importantes, como son la adopción de hijos del otro miembro de la pareja, la adopción conjunta y la reproducción asistida”, dice el Dr. Helmut Graupner, presidente del Rechtskomitee LAMBA (RKL). “Pero en definitiva no daremos gracias por el hueso que han echado a nuestros pies”.

Sexuality is an integral part of the personality of every human being.  Its full development depends upon the satisfaction of basic human needs such as the desire for contact, intimacy, emotional expression, pleasure, tenderness and love.
Sexuality is constructed through the interaction between the individual and social structures. Full development of sexuality is essential for individual, interpersonal, and societal well being.  
Sexual rights are universal human rights based on the inherent freedom, dignity, and equality of all human beings.  Since health is a fundamental human right, so must sexual health be a basic human right.  In order to assure that human beings and societies develop healthy sexuality, the following sexual rights must be recognized, promoted, respected, and defended by all societies through all means.  Sexual health is the result of an environment that recognizes, respects and exercises these sexual rights.

1.-The right to sexual freedom.  Sexual freedom encompasses the possibility for individuals to express their full sexual potential.  However, this excludes all forms of sexual coercion, exploitation and abuse at any time and situations in life. 

2.- The right to sexual autonomy, sexual integrity, and safety of the sexual body.  This right involves the ability to make autonomous decisions about one’s sexual life within a context of one’s own personal and social ethics. It also encompasses control and enjoyment of our own bodies free from torture, mutilation and violence of any sort.

3.- The right to sexual privacy.   This involves the right for individual decisions and behaviors about intimacy as long as they do not intrude on the sexual rights of others.

4.- The right to sexual equity. This refers to freedom from all forms of discrimination regardless of sex, gender, sexual orientation, age, race, social class, religion, or physical and emotional disability.

5.- The right to sexual pleasure.  Sexual pleasure, including autoeroticism, is a source of physical, psychological, intellectual and spiritual well being.   

6.- The right to emotional sexual expression.   Sexual expression is more than erotic pleasure or sexual acts.  Individuals have a right to express their sexuality through communication, touch, emotional expression and love.

7.- The right to sexually associate freely.  This means the possibility to marry or not, to divorce, and to establish other types of responsible sexual associations.

8.- The right to make free and responsible reproductive choices.  This encompasses the right to decide whether or not to have children, the number and spacing of children, and the right to full access to the means of fertility regulation.

9.- The right to sexual information based upon scientific inquiry.   This right implies that sexual information should be generated through the process of unencumbered and yet scientifically ethical inquiry, and disseminated in appropriate ways at all societal levels.

10.- The right to comprehensive sexuality education.   This is a lifelong process from birth throughout the lifecycle and should involve all social institutions.

11.- The right to sexual health care.  Sexual health care should be available for prevention and treatment of all sexual concerns, problems and disorders.

THE VALENCIA’S DECLARATION ON SEXUAL RIGHTS
VALENCIA, SPAIN JUNE 29th, 1997
We, the participants of the XIII World Congress of Sexology, Sexuality and Human Rights, state that:
Sexuality is a changing and dynamic dimension of humanity, which is constructed by aims of mutual interaction between individual and social structures. It is presented throughout the life cycle harmonizing identity, creating and/or strengthening interpersonal bonds.
Sexual pleasure, including self-eroticism, is a source of physical, psychological, intellectual and spiritual well-being. It is associated with a conflict and anxiety-free experience of sexuality, allowing, therefore, social and personal development.
Therefore, we urge society to create conditions in order to satisfy the needs for the full development of the individual and respect for the following SEXUAL RIGHTS, alienable, inviolable and irreplaceable of the human condition:

The right to freedom. It excludes all forms of sexual coercion, exploitation and abuse at any time and situations in life. The struggle against violence is a social priority.

The right to autonomy, integrity and safety of the body. This right encompasses control and enjoyment of our owns bodies free from torture, mutilation and any sort of violence.

The right to sexual equity. This one refers to freedom from all forms of discrimination, paying due respect to sexual diversity, regardless sex, gender, age, race, social class, religion and sexual orientation.

The right to sexual health. Which includes the availability of all sufficient resources for the development of research and the necessary knowledge for its promotion. HIV/AIDS and STDs require more resources for research, diagnosis and treatment.

The right to wide, objective and factual information on human  sexuality. In order to allow decision-making regarding sexual life.

The right to a comprehensive sexuality education. From birth and throughout the life cycle. All social institutions should be involved in this process.

The right to associate freely. This means the possibility for people to gather together whether married or not, to divorce, and to establish other types of sexual associations.

The right to make free and responsible choices regarding reproductive life. The number and spacing of children and the access to means of fertility regulation. All children should be desired and loved.

The right to privacy. Which implies the capability of making autonomous decisions about sexual life within a context of personal and social ethics. Rational and satisfactory experience of sexuality is a requirement for human development.

HUMAN SEXUALITY IS THE ORIGIN OF THE DEEPEST BOND BETWEEN HUMAN BEINGS. AND IT IS ESSENTIAL TO THE WELL-BEING OF INDIVIDUALS, COUPLE, FAMILIES AND SOCIETY. THEREFORE, THE RESPECT FOR SEXUAL RIGHTS SHOULD BE PROMOTED THROUGH ALL MEANS.

SEXUAL HEALTH IS A BASIC AND FUNDAMENTAL HUMAN RIGHT.
